TINJAUAN YURIDIS PENETAPAN KEDARURATAN KESEHATAN MASYARAKAT AKIBAT COVID-19

Abstract

Covid-19 pandemic more and more infected, especially in Indonesia. Prevention is not only sufficient medically but also must be made in a clear regulation by the central government. One of the regulations that has been made is Presidential Decree No. 11 of 2020 concerning Determination of Corona Virus Disease 2019 Public Health Emergency (Covid-19). This Presidential Decree material is interesting to be examined using normative legal research because it is related to secondary data, especially primary legal materials. Based on the research and the results of the writer's discussion, it can be said that the Presidential Decree related to the determination of public health emergencies due to Covid-19 is not appropriate because the determination and revocation of public health emergencies as stipulated in Article 10 paragraph (4) of Law Number 6 Year 2018 concerning Immigration Health must be regulated in a Government Regulation not regulated in a Presidential Decree. In addition, the contents of a Presidential Decree are usually only concrete, individual and once completed (final). Meanwhile, if what is formed is a regulation such as a Government Regulation, the contents are abstract, generally applicable, and continuously.
